The Tokyo EDITION Gift Card Terms of Use
- ARTICLE 1 PURPOSE

- These Terms stipulate the terms and conditions for the use of Tokyo EDITION Gift Card, as defined below, issued by MT&M Hotel Management Co., Ltd. (hereinafter referred to as the “Company”) and users of Tokyo EDITION Gift Card (hereinafter referred to as “you”) will have transactions in accordance with these Terms.
- ARTICLE 2 DEFINITIONS

- Tokyo EDITION Gift Card
It means a prepaid card issued by the Company which offers a function enabling you to purchase and obtain the Products, etc. (as defined below) at the shops designated by the Company with the amount of money loaded electronically onto it before it can be used for any transaction (hereinafter referred to as the “Card”). - Products, etc.
They mean goods, services, rights, and other similar items to be purchased or obtained at Tokyo EDITION, Toranomon and Tokyo EDITION, Ginza (hereinafter referred to as the “Card Accepting Shop(s)”).

- ARTICLE 3 SHOPS ACCEPTING CARD

- You may use the Cards for the payment for the Products, etc. in the Card Accepting Shops.
- ARTICLE 4 ISSUANCE OF CARD

- A Card will be issued at the Card Accepting Shops. On the surface of the Card, “Issuer: MT&M Hotel Management Co., Ltd.” will be printed.
- ARTICLE 5 METHOD OF LOADING FUNDS

- Funds may be loaded onto a Card at the Card Accepting Shop at the time of issuance of the Card.
- Funds may be loaded onto a Card either with cash or with credit card or by the method of loading designated by the Company.
- A Card may be loaded with up to 100,000 yen.
- A Card may not be reloaded after it is issued.
- ARTICLE 6 USE OF CARD

- If you pay with a Card, you will present the Card at the time of payment in the Card Accepting Shop. The Card can be used for the payment for the Products, etc. within the balance of the Card. The total purchase amount of the Products, etc. is deducted from the balance of the Card, and the cash payment of the same deducted amount will be deemed as having been made. In this case, the total amount for the purchased Products, etc. and the balance of the Card after the payment will be shown in the gift card payment statement and you will confirm that there is no error in them. If you find any error in them, you will immediately notify the Company thereof. If the Company verifies the error, the Company will address the matter in the manner it deems appropriate.
- If the balance of a Card presented by you is short of the total purchase amount of the Products, etc., you will pay the shortage either with cash or by the method of payment designated by the Company.
- You can use multiple Cards for payment. However, if the total balance of the multiple Cards you use is short of the total purchase amount of the Products, etc., you will pay the shortage either with cash or by the method of payment designated by the Company.
- Even if you have multiple Cards, the balance of each Card cannot be consolidated into one Card.
- ARTICLE 7 CARD BALANCE INQUIRY

- The Card balance is shown in the gift card payment statement and you can also check it on the balance inquiry site (you can access it through the QR code on the back of the Card).
- If you check the balance on the balance inquiry site, you need a 16-digit Card number shown on the back of the Card and your 6-digit PIN.
- On the balance inquiry site, you can check the use history as well as the balance. However, the details of history information and the number of transactions in the history available on the website are to be decided by the Company for systemic reasons.
- It is impossible to check the balance of the Card that has expired.
- ARTICLE 8 REDEMPTION AND REFUND OF CARD VALUE

- The Cards are not redeemable or refundable for cash.
- ARTICLE 9 REISSUANCE

- Even if your Card is lost, stolen, falsified, forged, altered, or treated in other similar manners, the functions of the Card cannot be suspended or the Card will not be refundable or reissuable. Even if these events cause any damage to you, the Company will not assume any responsibility for it. The Company will process transactions by deeming a Card holder as a legitimate right holder for such Card except as stipulated in Article 10, paragraph 1.
- You should not deface or bend your Card or place it near a magnetic item, otherwise the Card or its functions may be broken by such handling. If the Card or its functions are broken, the Company may issue a new Card and transfer the balance from your old Card to the new Card at its discretion only if it is clear that the Card or its functions were not intentionally broken and the magnetic information of the Card or the Card number shown on the back of the Card is legible. In such a case, the Company may require you to submit the old Card in exchange for the new Card. Even if the Company does not issue a new Card, the Company will not assume any responsibility for the damage incurred by you by such breakage.
When issuing a new Card, the Company will designate a design and attributes of the Card and you will not raise any objection. The Company will not make any refund in connection therewith.
- ARTICLE 10 ILLICIT ACQUISITION, USE, ETC.

- If the case falls under any of the following, the Company will decline your use of the Card, treat the Card itself as invalid, and request a handover of your Card to the Company:
(i) If you have acquired the Card in an illicit manner or used the Card while being aware, or under the circumstances where you may be aware, that it was acquired in an illicit manner;
(ii) If the Card is falsified, forged, or altered;
(iii) If you are in breach of any of these Terms; or
(iv) If the Company otherwise deems that the Card was illicitly used based on a reasonable ground. - If the case is suspected to fall under any of the items in the preceding paragraph, the Company may temporarily keep the Card for investigation.
- If the Card itself becomes invalid in this Article, paragraph 1, the Company will not exchange, reissue, refund, or make other similar arrangements for such Card. The Company will not assume any responsibility for the damage incurred by you resulting from the invalidity of the Card under this Article, paragraph 1 or the keeping of the Card under this Article, paragraph 2.
- If the case falls under any of the following, the Company will decline your use of the Card, treat the Card itself as invalid, and request a handover of your Card to the Company:
- ARTICLE 11 CARD VALIDITY

- The Cards are valid for six months from the date of loading funds. If a Card has expired, such Card becomes invalid and unusable thereafter whether with or without balance. The balance will not be refunded for whatever reason. You can check the validity of a Card on the balance inquiry site.
- ARTICLE 12 SYSTEM MAINTENANCE, FAILURE, ETC.

- The Company takes all possible precautions in designing and managing the system for the Cards; provided, however, that the Company may suspend a part or all of the use of the Cards without notice at a part or all of the Card Accepting Shops due to power outage, system failure, maintenance, and the security management against forgery of a Card or under other unavoidable circumstances. In that case, the Company will not assume any responsibility for any disadvantage or damage resulting from your Card being unusable.
- ARTICLE 13 PROHIBITION OF CREATION OF SECURITY RIGHTS INCLUDING PLEDGE

- You may not create any security right including pledge on the Cards. If you are in breach of this provision, the Company will not assume any responsibility for any trouble and other similar events arising from such breach.
- ARTICLE 14 AMENDMENT OF TERMS

- The Company may amend these Terms without notice at its discretion.
- If the Company amends these Terms, the Company will post an announcement showing the amended Terms (hereinafter referred to as the “New Terms”) and the effective date of the New Terms at the Card Accepting Shops and on the web page accessible via the QR code on the back of the Cards, and if you use your Card on or after the day following such effective date, you are deemed to have agreed to the provisions of the New Terms and the New Terms will apply to the use of the Cards and other matters under these Terms.
- ARTICLE 15 JURISDICTION

- If any dispute arises with the Company in relation to the transactions under these Terms, the district court having jurisdiction over the head office of the Company will be the court with exclusive agreed jurisdiction for the first instance.
